PIS Terms & Conditions of Use – for Payers (version 2021-01)

Service

This service is offered by Worldline for the purpose of accessing your online payment account at your Bank (as defined further) with your security credentials and consists of three actions:

(i) The payment details of the transaction will be transmitted by Worldline’s payments platform to establish, on your behalf, a secure, encrypted connection to your Bank (as defined further);

(ii) The confirmation of the successful initiation of payment order with your Bank (as defined further) is forwarded by Worldline’s payments platform to the payee for the purpose of the payee verifying such successful initiation of payment order and in order to prevent fraud or other criminal acts as well as to meet legal requirements; and

(iii) We will inform you of the proper initiation by your Bank (as defined further) of the payment order to which you consented to. It does not entail the confirmation of the payment execution,

(together the “Service”).

The authentication as well as (the confirmation of) the execution of this SEPA credit transfer (including the establishment of payment order information) itself from your payment account will be performed by your payment account service provider, e.g. your bank (“Bank”).  The Service consists of a user friendly additional interface between you and the interface of your online’s Bank. 

If you do not accept these PIS Terms & Conditions of Use, please do not use the Service.

By using the Service, you - as Payer – explicitly agree that information about you and the payment initiation order provided to your Bank is used by Worldline for the purpose of initiating the payment order on a SEPA credit transfer, which your Bank may then execute, and such information can be disclosed to the payee (e.g. Payer’s IBAN provided by your Bank and other information to initiate a credit transfer from the payee to you in the event of charge-back).

Once you - as Payer - have validated the payment order by clicking the concerned button on the Worldline online interface, you will be deemed to have expressly given your consent and authorized the payment order to be initiated immediately, which Worldline shall reasonably endeavor to be done within 12 hours. You acknowledge and agree that you cannot withdraw or revoke your consent after this moment of consent.

Immediately after initiation, your Bank shall provide or make available to Worldline, who subsequently shall provide or make available to the payee, the following data:

(i) confirmation of the successful initiation of the payment order with your Bank;

(ii) a reference enabling you to identify the (execution of the) payment transaction;

(iii) the amount and currency of the payment transaction;

knowing that (the confirmation of) the execution of the SEPA credit transfer is under responsibility of the bank of the Payer and therefore, Worldline cannot and does not guarantee (the confirmation of) the correct or proper execution of the payment.

The Service provided by Worldline is free of charge for you. By initiating a payment order, please be aware that your Bank may charge you fees for the execution of the SEPA credit transfer (and any of its related functionalities).  You acknowledge you are solely responsible for any and all such fees applied.

General requirements for eligibility to use the Service

To use the Service, you must be at least eighteen (18) , or of such age as required by the payee, with capacity to enter into legally binding contracts and must have the right to dispose of the assets available in the online Bank accounts you use in connection with the Service.  You hereby confirm that these requirements are met. You confirm that you shall not use the Service for any purpose that is in violation of its agreements with third parties (including the Bank(s) used in connection with the Service) or applicable law. You are personally responsible for any and all such violations and acknowledges, by using the Service, that the use of the same does not result in any such violation.

Suspension of the Service

Worldline may have to suspend the Service to deal with technical changes or impediments, to update the Service to reflect changes in relevant laws and regulatory requirements, or if it has indications on the illegal, fraudulent or unlawful use its products, software or Service.

Liability & Complaints

The service provided by Worldline is limited to the establishment of secure, encrypted connection to your Bank. Worldline is not responsible for the proper performance of the bank transfer.  For any information or claim regarding the proper performance of the initiated payment order, SEPA Credit Transfer, instant payment,… (e.g. unauthorized transaction, refund claim, etc.), you have to contact your Bank directly.

Worldline is not liable for any loss and/or damage to you as the result of your own fault or failures by the external parties (e.g., your Bank, your internet provider, payee, its bank or its internet provider, etc.).  Worldline cannot be held liable for business interruption, loss of opportunity, reputation, goodwill and/or revenue, as well as cost for temporary engagement of external resources. In any event, Worldline’s liability arising out of the Service cannot exceed an aggregate of 150 euros. 

Governing law

These Terms of Use and the agreement it constitutes shall be governed by Belgian laws. In case the parties would not be able to amicably settle a dispute, the courts of Brussels shall be competent to handle the dispute.

Severance

If any provision of these Terms & Conditions of Use is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms & Conditions of Use which shall remain in full force and effect.   If any provision of these Terms & Conditions of Use is so found to be invalid or unenforceable but would cease to be invalid or unenforceable if some part of the provision were deleted, the provision in question shall apply with such modification as may be necessary to make it valid and enforceable.
